1. Responsible Entity

These Terms and Conditions (hereinafter referred to as "Terms") apply to the use of the digital platform "StayWell", provided by StayWell GesbR, Kauergasse 8, 1150 Vienna, Austria (hereinafter referred to as "StayWell"). They govern the contractual relationship between StayWell and the users of the platform.

By registering or using the platform, users agree to these conditions.

Subject of use

StayWell provides a digital platform for delivering knowledge, motivation, and incentives to promote holistic well-being. The platform offers content in the areas of mental health, physical activity, sleep, nutrition, and stress management. It includes:

- Short daily knowledge boosts (text, video, audio)
- Challenges for behavior change
- Gamified features like points and reward systems
- Personalized recommendations based on user behavior

The content provided by StayWell does not replace medical advice, diagnosis, or treatment. Usage is at the sole responsibility of the users.

Access Requirements and Registration

Registration is required for full access.
During registration, truthful and complete information must be provided. Multiple registrations under false identity or automated registration are not allowed.

Usage Rights and Content

All content on the platform is protected by copyright.

StayWell grants users a simple, non-transferable right to use, solely for personal use. Commercial use, distribution, or reproduction without explicit written consent is prohibited.

Rules of conduct and obligations of users

Users are committed to respectful and factual interaction on the platform. It is prohibited to publish illegal, discriminatory, or misleading content.

The technical integrity of the platform must not be compromised by manipulation, hacking, or other interventions.

Violations of these rules may lead to termination of the user account and possibly legal action.

Contract Duration and Cancellation

The usage relationship begins with successful registration and continues indefinitely. Users can terminate the usage relationship at any time by deleting their account.

StayWell reserves the right to terminate the usage relationship with a reasonable notice period or immediately in case of breaches of duty.

Costs and Payment Terms

The use of basic features is free of charge. Paid subscriptions may be offered for certain content or additional features. Prices, durations, and payment terms will be clearly displayed before completion. Subscriptions will renew automatically unless canceled in due time.

Disclaimer

StayWell assumes no liability for any direct or indirect damages resulting from the use or unavailability of the platform, unless they are based on intent or gross negligence.

Final Provisions

The law of the Republic of Austria shall apply, excluding the UN Convention on Contracts for the International Sale of Goods.

The place of jurisdiction for disputes is Vienna.

Should individual provisions of these terms and conditions be or become invalid, the validity of the remaining provisions shall remain unaffected.

StayWell reserves the right to change these terms and conditions at any time. Changes will be announced by email or directly on the platform.
